1. Service Description

Myriagon provides website monitoring and testing services, including:

• Synthetic user interaction tests
• Uptime monitoring
• Performance and page metrics analysis
• Visual integrity and accessibility checks

Services are offered through a free trial and a pay-as-you-go model thereafter.

2. User Accounts

You must create an account to access our services. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

3. Free Trial

We offer a 7-day free trial with access to all features, subject to usage restrictions:

• Limited number of tests and executions
• Lower frequency of monitoring
• Restricted data volume

We reserve the right to limit or terminate trial access in case of misuse or abuse.

4. Pay-as-you-go Billing

Myriagon operates on a pay-as-you-go basis. Users are solely responsible for:

• Monitoring their usage and associated charges
• Ensuring correct configuration to avoid unintended costs
• Understanding that fees apply to all recorded activity

Usage alerts may be provided for convenience but do not absolve responsibility for charges.

5. Acceptable Use

Users agree not to:

• Use the service for malicious testing or attacks
• Interfere with third-party systems
• Reverse-engineer or copy any part of the platform
• Use the platform to test or monitor websites or systems they do not own or have explicit authorization to test
• Bypass security measures such as CAPTCHA, authentication forms, or rate limits unless explicitly authorized

Violations may result in immediate suspension or termination of access.

6. Service Availability

While we strive for high availability, we do not guarantee uninterrupted service. Downtime may occur due to:

• Scheduled maintenance
• Unexpected failures
• Force majeure events

We are not liable for any direct or indirect losses due to outages or service issues.

7. Limitation of Liability

The service is provided \"as-is\" and is not intended for use in life-critical or high-risk environments. Myriagon disclaims all warranties, express or implied, and is not responsible for:

• Misinterpretation of data or test results
• Decisions made based on service outputs
• Consequences of misconfigured usage
• Indirect, incidental, or consequential damages including lost profits, revenue, data, or reputation

Liability is limited to the amount paid for services in the three months preceding the claim. Users must independently validate results before acting on them.

8. Data & Privacy

All user data, including logs, screenshots, and test results, are stored in secure datacenters located in Paris, France, in compliance with the GDPR.

We do not sell user data. Only operational and diagnostic data is collected for service improvement. Please refer to our Privacy Policy for more details.

We reserve the right to use anonymized, aggregated usage data for analytics and feature enhancement.

9. Intellectual Property

All content, code, and branding remain the sole property of Myriagon SAS. Users may not replicate, distribute, or reuse any part of the platform without written consent.

10. Suggestions

By submitting suggestions or feedback, users grant Myriagon a non-exclusive, royalty-free, irrevocable license to use such feedback for service improvement.

11. Modifications to Terms

These Terms may be updated periodically. Users will be notified via email or through the platform. Continued use after changes implies acceptance.

12. Termination

You may cancel your account at any time. We may suspend or terminate your account for violations of these Terms or non-payment. Data may be deleted after 30 days of account closure.

13. Governing Law

These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France.

14. Security Measures

We implement encryption, access control, and monitoring to protect your data. However, no system is perfectly secure. Users are responsible for protecting their own credentials and endpoint configurations.

15. Billing Transparency and Controls

A real-time usage dashboard is provided. Alerts may be sent when nearing usage limits, but users are responsible for monitoring usage. All billable activities are clearly detailed in our documentation.

16. Abuse and Misuse Reporting

If you suspect abuse or misuse of the platform, contact us at support@myriagon.io. We will investigate and take action if necessary.
